    Wow, just seen those videos. I hope the HSE see them as clearly they are wasting their time with investigating, it was just all meant to be! May God have mercy on us all!

    I wouldn't read too much into a comment like that. There's been nothing official from the HSE or park implying anything similar. The lawyer of the victims is hardly going to come out saying the rides fine and can open whenever it wants :)

    Edit : reading it again , its actually the HSE who made that comment to the lawyer in a meeting

    Paul Paxton, partner at Stewarts Law, added the officers (HSE) indicated the ride is likely to remain closed for a significant period of time and may never open again.

    Given Hydro reopened after a death, then cant see the Smiler closed for good, but its interesting they make such a remark!

    The HSE wouldn't say that, it's not their decision.
    They can only set out a list of corrections needed to make the ride "safe" then it's upto AT as to whether these are commercially viable.
    This ride was made by one of the worlds top manufacturers from Germany! Not some two bit dodgy shed in China, it would damage their reputation severely if it doesn't reopen so it almost definitely will.
    I'm afraid the leach is talking Muslim again.

    Correct - the HSE wouldn't make that decision. Totally up to the park after they have made any necessary improvements required.

    Also, whilst they say there is no expense being spared with the investigation, that will get charged back to Merlin, so no reason why they wouldn't spend as much as they want! The law was changed a few years ago that allowed the HSE to charge for their activities where breaches of legislation have been identified. It wouldn't surprise me if the costs of the HSE investigation end up being more than any fine that gets dished out.

    Look, it's not the HSE decision. They will give them a lis of things to do before it reopens and its up to Alton towers to decide weather or not it is worth it. Say the list is (example):

    New cars without the bar to crush their legs
    Some sort of evacuation process that doesn't involve mountain rescuers
    More cameras
    More sensors

    Alton towers would then have to make the decision if these would be too expensive. Then they would close it. The ride cost 18 million. Not going to close. Probably will be outlived by every other rollercoaster in the park (exception of spinball and octanauts)

    Also, this is really making me angry.

    Is it just me or does anyone else think that they should have expected an answer as they probably just went to the person in the game stand. it is probably part of the parks policy to ignore this.

    I can't see them closing the ride whether the changes are commercially viable or not, all this would do is damage their reputation further and give people the opportunity to say "see I knew it was a death trap!"

    The lawyer representing some of the victims is now claiming The Smiler may never open again. Obviously he's in no position to determine whether a ride or not will reopen.

    The lawyer is just media whoring, these news stories don't help the victims. But it does get his firms name in the press.

    Plenty of delicious free advertising
