That will be a different piece of legislation but it will be in there somewhere if you can be bothered to look, I can’t.

What difference does it make anyway? Just do as asked, it’s not really that complicated and shouldn’t even need legislation if people weren’t so damn selfish.
Think of the people still isolating and the bigger picture rather than looking for excuses.

Because without legislation it's unenforceable, and people can't be trusted.

Well, as I discussed in the Alton Towers General thread there is some ambiguity about whether, for example, any of the hotels could offer a buffet breakfast as they might be considered licensed premises. The legislation would answer the question definitively. If you were running a business you might consider it a courtesy to know what you actually need to do before it becomes law.

More than happy to do as asked. However, for businesses the broad outline of the rules is not enough. They need details on who precisely they are affected and to what extent.

When something is enacted into law, it no longer becomes an ask. Businesses are struggling enough as it is they need to know exactly where they stand, with enough time to make adequate consideration on what they need to change. That's particularly the case when such hefty fines are involved.

I'm curious if it would impact on Oktoberfest... does that count as alcohol being consumed off the premises?

... during the emergency period, a person responsible for carrying on a business or providing a service listed in Part 1 of Schedule 3 which serves alcohol for consumption on the premises may sell food or drink for consumption on the premises only if—
(a) the food or drink is ordered by, and served to, a customer who is seated on the premises; and
(b) the person takes all reasonable steps to ensure that the customer remains seated whilst consuming the food or drink on the premises

Edit to add - I think it would apply to Oktoberfest after all, paragraph (3) explicitly says the premises includes the area made available for customers where seating is provided.

(3) For the purposes of paragraphs (1) and (2), an area adjacent to the premises of the business where seating is made available for customers of the business (whether or not by the business) or which customers of the business habitually use for consumption of food or drink served by the business is to be treated as part of the premises of that business

My interpretation was that if they don't serve alcohol, places must ensure guests sit whilst eating.

For Oktoberfest it sure looks like the lawns are licensed, given the no alcohol beyond these point signs.

But my overriding thought is: I'm sure glad I'm not the person responsible for ensuring a business is legally following this mess.

Almost all buffets haven’t been operating since restaurants re-opened in July anyway.
Pizza Hut are just providing unlimited pizza via waited service, once you finish a pizza you can get another.

The one nearest to me has just announced they are not reopening yet due to this, there are a few that are open now and going by what they have said it’s business as usual nothing is changing. So that’s why this whole situation is confusing but I dread to think how more confusing and frustrating it must be for a business owner.

it was said on the London news this morning that police will concentrate on public spaces and moving gatherings on.
I expect for pubs etc they will continue as the currently are doing and will only attend when there is serious obvious issues with guests spilling out the door and loud or unruly conduct.
I don’t expect much to be done about venues that fail to offer mainly table service, maybe if customers complain to police or the local council several times that the venue feels unsafe they will get a visit. It’s the pub crawls and similar selfish behaviour I can see more effort being put into.

Pizza Hut only offer buffet 12-3pm weekdays. That won’t be the reason they aren’t re-opening. More likely the restaurant just wasn’t profitable anyway.

just re-read your reply and assume you actually refer to a more general not Pizza Hut restaurant.

Most of those places are lowest quality, cheap don’t give a care about service anyway. I really doubt they have done any risk assessments for Covid secure operations anyway.
 
Also on buffets, although there is nothing specific in the guidance, these points should indicate they really should find a better way to operate. From https://www.gov.uk/guidance/working...s-offering-takeaway-or-delivery#takeaways-2-2

so it is up to the venues to do a risk assessment and operate Covid secure, but I wouldn’t trust some places not to give me food poisoning let alone a pandemic virus!

Is this plastic see-through visors that are being referred to here, and not face masks? Because I initially thought you were referring to face masks, which confused me as I’ve seen quite a few articles inferring the exact opposite, but now I’m not too sure which you mean.

Yes, face shields, as many businesses like waiters, shop assistance etc.. are just wearing face shields. For face shields to be effective, they need to be worn with a mask.
